Filing a Complaint Against the Hospital

Bedsores, with proper care and attention, can be completely preventable in many cases. With Medicare's new stance regarding nonpayment for preventable conditions such as bedsores, the costs of caring for individuals who develop bedsores during a hospital stay can quickly increase. Furthermore, if the care given by the hospital staff does not meet the minimum requirements necessary to prevent the development of bedsores, it may be a case of neglect.

Hospitals that are understaffed, or that do not have sufficient medical equipment available for bedsore prevention may fall short when it comes to assessing and evaluating patients. In these circumstances, you may wish to file a complaint with the appropriate regulatory agency. If you're on Medicare, you may also wish to file a complaint against the hospital through that agency as well. However, you should be aware that Medicare does not accept complaints based upon circumstances such as the attitude of the caregiver or certain conditions with regards to your room.

In general, you may wish to file a complaint if you have problems with any of the following and are unable to reach a resolution with the hospital and hospital staff:

  • Acceptable Treatment Practices
  • Regulation Violations
  • Medical Negligence
  • Medical Malpractice

These are several broad areas where the hospital may fall short in providing the type of care that you need in order to prevent bedsore development or other complications. If you do decide to file complaint against the hospital, you should seek the advice of a competent legal professional who specializes in these types of issues. With solid legal device, you can make the best decision possible with regards to what actions to take in order to preserve your legal rights and recover damages that you may be owed. A trained legal professional will be able to advise you with regards to your rights as a patient and will also be able to assist with any complaints that you filed with regulatory agencies or Medicare.
